Workers' Compensation Claims Attorneys
How to File a Workers' Compensation Claim
Have you been injured while performing the functions of your job or suffered
illness or disease due to exposure to harmful substances at the workplace?
If so, there is a high chance that you may be able to file a worker's
compensation claim and collect benefits as you recover. The first step
to take following an injury is to seek immediate medical treatment. Secondly,
you should notify your employer within 30 days of your intent to file
a worker's compensation claim. Failing to do so within this time frame
may prevent you from receiving benefits.
After your employer has been informed of your injuries, the process is
as follows:
- Within one work day, your employer is required to submit a report to the
Department of Labor and Workforce Development's Worker's Compensation Division.
- Your employer will notify its worker's compensation insurance carrier
of the injury.
- Within two days of being informed, the insurance company will contact you
within 15 days, and will give notice that they either accepted or denied
the claim.
