At some point during your case, the insurance company will probably ask that you submit to an "independent medical exam." Don't be fooled by the name; there is nothing independent about it. The insurance company hires a doctor it knows will minimize your injuries. The following suggestions should help you through this examination and control the impact it will have on your case.

  1. Bring two copies of your medical timeline to the examination - one for the doctor and one for you.

  2. Be prompt for the appointment, even though some insurance doctors are over booked and you may wait a considerable time before seeing the doctor. Be on time and be patient.

Waddell Test

What you should know about the Waddell Test

A doctor named Gordon Waddell noticed that some patients complained about pain, however, he couldn't find any reason for such complaints. He decided to develop tests to determine if the complaints of pain were based on injuries or if the patient was malingering, imagining the pain, or making a fraudulent claim. Supposedly, if a patient reacted, to any of these tests, the patient was "faking it." Now, insurance doctors are using these tests to suggest you are "faking it!" By the way, the insurance doctor makes thousands of dollars working for insurance companies. It's in his financial best-interest to say your claim is phony!
